Notified About: A Utah Notice of proposed rule concerning Underground Storage Tanks: Certificate of Compliance and Financial Assurance Mechanisms

Highlights
The Department of Environmental Quality has published a Notice outlining a proposed rule to:
- require owners or operators of aboveground petroleum storage tanks (APSTs) to declare a form of financial assurance to obtain a Certificate of Compliance
- add further requirements for APSTs that choose to participate in the Environmental Assurance Program (EAP)
- define eligible exempt aboveground storage tanks (ASTs) participation in the EAP
- add requirements for delivery prohibition for APSTs and
- remove Subsection R311-206-10(2) that no longer required facilities to do a site check to participate in the EAP after a period of non-participation.
Interested persons are invited to submit written or oral comments before 1 July 2022 to the Department of Environmental Quality.
