Highlights

The Department of Environmental Quality has published a Notice of Rule Effective Date with reference to a previously published Proposed Rule to:

  • require owners or operators of aboveground petroleum storage tanks (APSTs) to declare a form of financial assurance to obtain a Certificate of Compliance
  • add further requirements for APSTs that participate in the Environmental Assurance Program (EAP)
  • define the eligible exempt aboveground storage tanks
  • add requirements for delivery prohibitions for APSTs and
  • specify that facilities do not need to do a site check to participate in the EAP after a period of non-participation.
