Highlights

The Environmental Protection Agency has published a proposed Rule to: 

  • outline the 26 states’ obligations to eliminate significant contributions of the 2015 ozone National Ambient Air Quality Standard (NAAQS) 
  • establish the budgets for nitrogen oxides emissions by requiring fossil fuel-fired power plants in 25 states to participate in an allowance-based ozone season trading program from 2023
  • establish applicable nitrogen oxides emissions limitations to certain other industrial stationary sources in 23 states with an earliest possible compliance date of 2026
  • outline a list of industrial source types and 
  • clarify that interested persons may submit comments, by 6 June 2022, to https://www.regulations.gov/ with the Docket ID number.
