Highlights
The Department of Energy and Environment has published Rule 2, as amended, which establishes the water quality standards for surface waters of the State of Arkansas.

The amended Rule was published in 2020, adopted by the State Agency on 1/28/2022, reviewed by the Legislative Council on 4/22/2022 and certified as having been adopted on 4/27/2022.

Specific standards that shall apply to all surface waters of the State are set out in Chapter 5 of the Rule.

The Division of Environmental Quality will provide, on a case-by-case basis, a reasonable time for an existing permittee to comply with any new or revised water quality based effluent limits in case of discharge to surface water. Compliance schedules may be included in National Pollutant Discharge Elimination System (NPDES) permits at the time of renewal or permit modification initiated by the Division to require compliance with new water quality standards.
