Highlight:

The Welsh Ministers have published regulations which amend the Health Protection (Coronavirus Restrictions) (Wales) Regulations 2020 (the "principal regulations"), which are currently being added to your legal register, by:

-clarifying that the Ministers can terminate any requirement or restriction imposed by the principal regulations in relation to specific businesses, categories of persons or particular areas of Wales
-requiring people responsible for businesses or services carried on in listed premises to take reasonable measures to ensure that a distance of 2 metres is maintained between people on the premises
-clarifying that the restriction on leaving the place where a person is living without reasonable excuse also includes remaining away from that place without reasonable excuse
-making it clear that persons can visit banks and similar establishments to withdraw and deposit money
-making clear that exercising more than once a day if needed because of a particular health condition or disability and visiting a burial ground or garden of remembrance to pay respects are both reasonable excuses for leaving the place where they live.

-making it clear that providers of holiday accommodation can provide services online or by telephone or post, and can open premises at the request of the Welsh Ministers or a local authority
-requiring a person responsible for work carried out at any place during the emergency period to take all reasonable measures to ensure that a distance of 2 metres is maintained between persons on the premises
-clarifying that the requirement of a distance of 2 metres between persons in a place of worship, crematorium or community centre does not apply to persons from the same household or to carers and persons they are caring for
-stating that a person responsible for a cemetery must take all reasonable measures to ensure that a distance of 2 metres is maintained between persons from different households attending a burial at the cemetery
-defining “cemetery” and “burial”
-requiring any person who is subject to a requirement to take all reasonable measures to ensure a distance of 2 metres between persons at a place to have regard to guidance from the Welsh Ministers about taking those measures
-stipulating that attending a funeral is a reasonable excuse to leave the place where a person is living if the person is responsible for arranging the funeral or is invited.

Public Health (COVID-19 Restrictions on Gathering and Movement) Amendment Order 2020

Highlight:

The Minister for Health and Medical Research has published the Coronavirus (COVID-19): Public Health (COVID-19 Restrictions on Gathering and Movement) Amendment Order 2020 (the "Amendment Order").

The Amendment Order amends the Public Health (COVID-19) Restrictions on Gathering and Movement) Order 2020, which is currently being added to your legal register, by:

-permitting truck drivers and their passengers to use facilities at truck stops
-excluding persons involved in conducting a funeral from the 10-person limit for funeral services
-enabling services at places of worship to be streamed or otherwise recorded
-enabling caravan parks and camping grounds to be used by overnight travellers, persons working in the local area and persons whose primary places of residence are temporarily unavailable
-allowing auctions for food supply or a fibre or crop auction to be conducted (whether indoors or outdoors).

Treasury Legislation Amendment (COVID-19) Act 2020 No 2

Highlight:

The Legislature of New South Wales has now published the Treasury Legislation Amendment (COVID-19) Act 2020 (the "Amendment Act"). You were previously notified on the the Act when it was still in Bill format.

The Amendment Act amends the Long Service Leave Act 1955 and Payroll Tax Act 2007 in response to the COVID-19 pandemic by:

-allowing an employer to give a worker a period of long service leave of less than 1 month before the worker becomes entitled to long service leave
-permitting an employer to give less than 1 month’s notice of when long service leave is to be given and taken
-providing that an employer must only pay 75% of the payroll tax on wages for the financial year that began on 1 July 2019, if all Australian wages paid or payable are $10,000,000 or less
-increasing the threshold amount for payroll tax liability for the financial year that began on 1 July 2020 and subsequent financial years to $1,000,000.

COVID-19 Legislation Amendment (Emergency Measures) Act 2020 No 1

Highlight:

The Legislature of New South Wales has published the COVID-19 Legislation Amendment (Emergency Measures) Act 2020 (the "Amendment Act"). You were previously notified of the Amendment Act when it was in Bill format.

The Amendment Act makes amendments to a number of Acts to implement emergency measures as a result of the COVID-19 pandemic including the:

-Electronic Transactions Act 2000 by providing for alternative arrangements for signing and witnessing documents

-Environmental Planning and Assessment Act 1979 by allowing the Minister for Planning and Public Spaces to make an order that authorises development to be carried out on land without the need for approval or consent, if the order is necessary to protect the health, safety and welfare of the public

-Workers Compensation Act 1987 by requiring workers to have the first certificate of work capacity in relation to the payment of weekly income support payments as well as a second or subsequent certificate.

Public Health (COVID-19 Restrictions on Gathering and Movement) Order 2020

Highlight:

The Minister for Health and Medical Research has published the Public Health (COVID-19 Restrictions on Gathering and Movement) Order 2020 (the "Order").

The Order attempts to deal with the public health crisis presented by COVID-19 by, among other things:

-directing that a person must not, without reasonable excuse, leave their residence
-defining what constitutes a reasonable excuse
-stipulating that a person must not participate in a gathering in a public place of more than 2 persons, unless the gathering is of members of the same household or it is essential for work or education
-creating offences and imposing penalties for non-compliance on both individuals and corporations.

The Health Protection (Coronavirus Restrictions) (Wales) Regulations 2020

Highlight:

The Welsh Ministers have published the Health Protection (Coronavirus Restrictions) (Wales) Regulations 2020 (the "Regulations").

The Regulations:

-revoke and replace the Health Protection (Coronavirus, Business Closure) (Wales) Regulations 2020 and the Health Protection (Coronavirus: Closure of Leisure Businesses, Footpaths and Access Land) (Wales) Regulations 2020
-require the closure of businesses selling food or drink for consumption on the premises and listed businesses to protect against the risks to public health arising from coronavirus
-allow premises used for certain listed businesses or services to broadcast a performance (whether over the internet or as part of a radio or television broadcast)
-state that persons responsible for holiday or camping sites, with some exceptions, must require any person staying at the site when the business has ceased to vacate the premises
-place restrictions on certain other businesses and services during the emergency period
-stipulate that places of worship, crematoriums and community centres must close subject to exceptions which include providing essential voluntary services to homeless or vulnerable people and providing urgent public services
-prohibit any person from leaving the place where they are living without a reasonable excuse as defined
-prohibit gatherings of more than 2 people, unless in specified situations
-imposes a requirement on local authorities, National Park authorities, Natural Resources Wales and the National Trust to close certain public paths and land accessible by the public
-set out penalties for non-compliance.

The restrictions and requirements imposed by the Regulations will be reviewed at least once every 21 days, with the first review being carried out by 15th April 2020. The Regulations expire on 26 September 2020.

The Health Protection (Coronavirus: Closure of Leisure Businesses, Footpaths and Access Land) (Wales) Regulations 2020

Highlight:

The Welsh Ministers have published the Health Protection (Coronavirus: Closure of Leisure Businesses, Footpaths and Access Land) (Wales) Regulations 2020 (the "Regulations").

 

The Regulations place obligations on persons responsible for leisure businesses and holiday sites to:

-close leisure businesses during the emergency occasioned by the serious and imminent threat to public health posed by the incidence and spread of coronavirus

-require any person using a mobile home or caravan on the site when the premises are closed to vacate the premises

-close certain public footpaths and land during the emergency.

 

The Regulations also prescribe offences for non compliance.

The restrictions imposed by the Regulations will expire after 6 months from the date they come into effect.

The Health Protection (Coronavirus, Business Closure) (Wales) Regulations 2020

Highlight:

The Welsh Ministers have published the Health Protection (Coronavirus, Business Closure) (Wales) Regulations 2020 (the "Regulations").

The Regulations state, among other things, that to protect against the public health risks arising from coronavirus, businesses listed in Schedule 1 must:


-close any premises in which food or drink are sold for consumption
-stop selling food or drink for consumption on their premises
-if they sell food or drink for consumption off the premises, stop selling food or drink for consumption on its premises during the relevant period.


The Regulations also set out what is not considered "food or drink sold for consumption on premises".

The restrictions imposed by the Regulations will be reviewed every 28 days. As soon as the Welsh Ministers consider that these restrictions are no longer necessary to prevent, protect against, control or provide a public health response to the coronavirus, a direction must be published terminating the relevant period.

The Health Protection (Notification) (Wales) (Amendment) Regulations 2020

Highlight:

The Welsh Ministers have published the Health Protection (Notification) (Wales) (Amendment) Regulations 2020 (the "Amendment Regulations").

The Amendment Regulations amend the Health Protection (Notification) (Wales) Regulations 2010 (“the 2010 Regulations”). The 2010 Regulations place obligations on various persons for the purpose of preventing, protecting against, controlling or providing a public health response to the incidence or spread of infection or contamination.

The Amendment Regulations add “Coronavirus Disease 2019 (COVID-19)” to the list of “Diseases and Syndromes” which medical practitioners must notify a relevant local authority on. This obligation exists if a patient that they are attending is believed to have a listed disease or syndrome.
