Highlight:
The Minister of Employment and Labour has published a consolidated Direction that applies to employers and workers in respect of:
-the manufacturing, supply or provision of essential goods or essential services; and

Medicines and Related Substances Act, 101 of 1965: Exclusion of Schedule 2, Schedule 3 and Schedule 4 Substances from the Operation of Certain Provisions of the Act

In inserting section 11K within the Disaster Management Act, 2002: Regulations issued in terms of Section 27(2) of the Act (GN 318), every employer conducting mining operations and activities at a mine, must implement appropriate measures to protect the health and safety of workers in respect of COVID-19.

Disaster Management Act 57 of 2002: Covid-19 Occupational Health and Safety Measures in Workplaces Covid-19 (C19 OHS), 2020
Highlight:
The Minister of Employment and Labour has published a Directive that applies to employers and workers in respect of:
-the manufacturing, supply or provision of essential goods or essential services; and

Every employer must check regularly on the websites of the National Department of Health, National Institute of Communicable Diseases, and the National Institute for Occupational Health whether any additional PPE is required or recommended in any guidelines, given the nature of the workplace or the nature of a worker’s duties.

Disaster Management Act 57 of 2002: Regulations issued in Terms of Section 27 (2) of the Act

Draft Framework for Consultation on COVID-19 Risk Adjusted Strategy
Highlight:
The South African Government has published a draft framework that intends to bring different sectors of the economy under the various levels of the Lockdown back to work as announced by President Cyril Ramaphosa.
Note that the classification of sectors in the draft framework follows the Standard Industrial Classifications (SIC) as published by Statistics South Africa. Where an entire division is permitted, it should be assumed that all sub-groupings are permitted as well. Where only certain sub-groupings are specifically permitted within a division, it should be assumed that other sub-groupings are not.
In the document, when moving between levels, the green text means additions or changes from the prior level. For example, Level 4 will add forestry and related services to Agriculture.
Sectors and business organisations / trade unions and members of the public are invited to submit comments on the schedule of services to be phased in as per the COVID-19 Risk Adjusted Strategy to be implemented with effect from 1 May 2020.
Feedback and / or comments should be submitted in via email to lockdowncomments@cogta.gov.za by 12h00, on Monday, 27 April 2020.
South Africa will be moving to level 4 economic activity as of 1 May 2020 therefore comments particularly on the proposals as contained in Level 4 are encouraged.

Statement by President Cyril Ramaphosa on South Africa's Response to the Coronavirus Pandemic
Highlight:
In response to the ongoing COVID-19 global pandemic, South African President Ramaphosa gave a statement on South Africa's response to the coronavirus pandemic.
Amongst other things, the statement declares that beyond 30 April 2020, South Africa will begin a gradual and phased recovery of economic activity.
A risk adjusted strategy will be implemented, through which a deliberate and cautious approach to the easing of current lockdown restrictions will be taken. This approach is guided by the advice from scientists who have advised that an abrupt and uncontrolled lifting of restrictions could cause a massive resurgence in infections.
To ensure that the response to the pandemic is as precise and targeted as possible, there will be a national level and separate levels for each province, district and metro in the country.
As part of this approach, there will be five coronavirus levels:
-Level 5 means that drastic measures are required to contain the spread of the virus to save lives
-Level 4 means that some activity can be allowed to resume subject to extreme precautions required to limit community transmission and outbreaks
-Level 3 involves the easing of some restrictions, including on work and social activities, to address a high risk of transmission
-Level 2 involves the further easing of restrictions, but the maintenance of physical distancing and restrictions on some leisure and social activities to prevent a resurgence of the virus; and
-Level 1 means that most normal activity can resume, with precautions and health guidelines followed at all times.
The National Coronavirus Command Council has determined that the national coronavirus alert level will be lowered from level 5 to level 4 with effect from 1 May 2020. This means that some activity will be allowed to resume subject to extreme precautions to limit community transmission and outbreaks. Some businesses will be allowed to resume operations under specific conditions. Every business will have to adhere to detailed health and safety protocols to protect their employees, and workplace plans will be put in place to enable disease surveillance and prevent the spread of the infection.
All businesses that are permitted to resume operations will be required to do so in a phased manner, first preparing the workplace for a return to operations, followed by the return of the workforce in batches of no more than one-third. In some cases, a sector will not be able to return to full production during Level 4 while the risk of infection remains high.
These will be spelt out next week following a final round of consultations and the relevant Ministers will provide a detailed briefing on the classification of industries and how each is affected at each level.
All industry bodies will be given an opportunity to consider these details and, should they wish, to make submissions before new regulations are gazetted.

The Regulations apply to all authorisations, certificates, applications and registrations made and / or issued in terms of the Electronic Communications Act 36 of 2005, Broadcasting Act and the Postal Services Act.
Amongst others, the Regulations intend to:
-facilitate the dissemination of information required for dealing with the National Disaster
-enable the facilitation of the national response to the National Disaster and post-disaster recovery and rehabilitation
-enable implementation of measures that may be necessary to prevent an escalation of the National Disaster or to alleviate, contain and minimise the effects of the National Disaster; and
-ensure that there is continuation of the provision of services in the Republic.
The Regulations are effective from 06 April 2020, and remain in effect until termination of the National State of Disaster.

Disaster Management Act 57 of 2002: Directions issued in terms of Regulation 10 (8) of the Regulations made under Section 27 (2) of the Act: Measures to Prevent and Combat the Spread of COVID-19
Highlight:
The Minister of Tourism has issued the Measures to Prevent and Combat the Spread of COVID-19 ("the Directions").
The Directions provide guidance on the implementation of the provisions relating to the rendering of essential services referred to in Annexure B of the Disaster Management Act, 2002: Regulations issued in terms of Section 27(2) of the Act (GN 318) ("the Regulations").
Annexure D of the Regulations provide places and premises that must remain closed to the general public. All establishments falling thereunder must adhere to the following:
-Employers must ensure that all employees at such establishments are trained on the COVID -19 health protocols
-Employers must ensure that the employees have personal protective equipment (PPE) and that all workplace health and safety legal requirements are observed
-Employers must provide all employees rendering essential services with accommodation onsite to enable them to remain in the establishments for the entire duration of the lockdown period
-All the establishments rendering services related to the lockdown, other than quarantine or isolation, must, in writing, obtain approval from the Department of Tourism
-All establishments rendering services in relation to quarantine or isolation are to be confirmed as such by the Health Authorities under the Department of Health working with the Department of Public Works and Infrastructure
-An accommodation establishment confirmed or designated as a quarantine or isolation facility, is not permitted to render essential services to any other person besides the people quarantined, isolated or essential service employees therein.
Only approved hotels which provide services related to the lockdown, other than quarantine or isolation, within airport precincts of OR Tambo, King Shaka and Cape Town International Airports, will be allowed to host airline crew for cargo flights bringing essential supplies or flights that are authorised for the evacuation of international tourists.
The Directions come into operation on 02 April 2020 (the date of publication in the Government Gazette).

The following Directions will apply:
-Directions relating to licences and environmental authorisations as contemplated in the National Environmental Management Act, 107 of 1998 (NEMA), the National Environmental Management: Waste Act, 59 of 2008 and the National Environmental Management: Air Quality Act, 39 of 2004
-Directions relating to exemptions contemplated in sections 74 to 77 and transfers of waste management licences contemplated in section 52 of the National Environmental Management: Waste Act, 59 of 2008, authorisations issued for the export of waste tyres contemplated in regulation 4(e) of the Waste Tyre Regulations, 2017, and applications for the amendment of orders to remediate contaminated land issued in terms of section 38 of the National Environmental Management: Waste Act, 59 of 2008; and
-Directions relating to reporting as contemplated in regulation 8 of the National Environmental Management: Air Quality Act 39 of 2004 - National Atmospheric Emission Reporting Regulations, 2015 and in regulation 7(1) and (2) of the National Environmental Management, 39 of 2004: National Greenhouse Gas Emission Reporting Regulations read with section 53(aA), (o) and (p) of the National Environmental Management: Air Quality Act, 39 of 2004.

Disaster Management Act 57 of 2002: Amendment of the Directions issued in terms of Regulations 10 (7) of the Regulations made in under Section 27 (2) of the Act: Measures to prevent and Combat the Spread of COVID-19 in the Public Transport Services
Highlight:
The Minister of Transport has issued amendments to the Measures to prevent and Combat the Spread of COVID-19 in the Public Transport Services (Government Notice No. 412 published in Government Gazette No.43157 of 26 March 2020).
Amongst others, the amendments insert provisions for employers to make arrangements for the transportation of workers who are rendering essentials services as listed in Annexure B of the Disaster Management Act, 2002: Regulations issued in terms of Section 27(2) of the Act (GN 318) in line with the operating shifts, work time schedules as determined by the responsible head of operations, Manager, Head of the Department or a person with responsible authority within such institution.
The operating shifts, work schedules or time table should be stamped and signed by such person with authority.
The amendments are effective from 31 March 2020 (the date of publication in the Gazette).

The Minister of Home Affairs has issued the Measures to prevent and combat the spread of COVID-19 ("the Directions").
The Directions intend to prescribe temporary measures or steps currently necessary to manage COVID-19 in order to reduce its impact in the Republic by preventing the importation of, and minimising the local transmission of the virus.
The Directions apply to citizens, permanent residents and other foreign nationals to whom the Immigration Act 13 of 2002 applies during the national state of disaster.
Amongst others, the Directions deal with the:
-withdrawal of visas
-suspension of visa exemptions
-refusal of visas
-refusal of admission for foreigners
-admission of citizens and permanent residents
-transit of foreigners through the Republic
-departure of foreigners from the Republic
-visa concessions for foreigners inside the Republic
-airline crew members and emergency medical rescue situations
-travel restrictions for citizens and permanent residents; and
-closure of some Ports of Entry.
The provisions of paragraph 17, relating to the National Lock-Down in the Republic, apply for the duration of the period of the National Lock-Down, and will include any period of extension thereto.

Disaster Management Act 57 of 2002: COVID-19 Temporary Employee / Employer Relief Scheme
Highlight:
The Minister of Employment and Labour has determined that it is necessary to implement steps in respect of the administration of the COVID-19 through the COVID-19 Temporary Employee / Employer Relief Scheme ("the Directive") to prevent an escalation of the COVID-19 infections funded through the National Disaster Benefit.
During this period of lockdown, companies will have to shut down and employees laid off temporarily. The Government has anticipated that employees may lose income. However, employers are encouraged to continue to pay employees, but where this is not economically possible; a special benefit has been created under the Unemployment Insurance Fund as per the Directive.
Amongst other, the Directive intends to:
-make provision for the payment of benefits to the Contributors who have lost income due to COVID-19 pandemic
-minimise the economic impact of loss of employment because of the COVID-19 pandemic
-contain the spread of COVID-19 during the process of application for benefit
-establish the Temporary Employee / Employer Relief Scheme and set out the application process for benefits of the COVID-19 pandemic; and
-make provision for online applications for benefits.
This Directive shall commence immediately from the date of publication by Minister of Employment and Labour notice in the Gazette (26 March 2020), and remains in operation for a period of 3 (three) months or until they are withdrawn by the Minister, whichever comes first.

The Regulations exempt a category of agreements or practices between designated retail tenants and the retail property landlords from the application of sections 4 and 5 of the Competition Act, 80 of 1998 in response to the declaration of COVID-19 pandemic as a national disaster in terms of the Disaster Management Act 57 Of 2002, for the purpose of:
-promoting concerted conduct to prevent an escalation of the national disaster and to alleviate, contain and minimise the economic and social effects of the national disaster; and
-enabling the retail property sector to minimise the negative impact on the ability of designated retail tenants, including small independent retailers, to manage their finances during the national disaster and be in a position to continue normal operations beyond the national disaster.
The Regulations deal with the category of agreements or practices exempted, including clothing, footwear, home textile retailers, personal care services and restaurants.
Given the unpredictability of managing the COVID-19 pandemic, the areas of collaboration and designated retail tenant list exempted in these Regulations may be expanded or reduced by the Minister by notice published in the Government Gazette in terms of these Regulations.

The Regulations exempt a category of agreements or practices between Banks, Banking Association of South Africa and/or Payments Association of South Africa from the application of sections 4 and 5 of the Competition Act, 80 of 1998 in response to the declaration of COVID-19 pandemic as a national disaster in terms of the Disaster Management Act 57 Of 2002, for the purpose of:
-promoting concerted conduct to prevent an escalation of the national disaster and to alleviate, contain and minimise the effects of the national disaster
-enabling the banking sector to minimise the negative impact on the ability of customers, including both business and private individuals, to manage their finances
-during the national disaster, and be in a position to continue normal operations beyond the national disaster; and
-enabling the banking sector to manage the banking infrastructure, including the payment infrastructure, ATMs and branches.
The Regulations deal with the category of agreements or practices exempted, including payment systems and debtor and credit management.
Given the unpredictability of managing the COVID-19 pandemic, the areas of collaboration exempted in these Regulations may be expanded or reduced by the Minister by notice published in the Government Gazette in terms of these Regulations.

The Compensation Commissioner has published the Notice on Compensation for Occupationally-Acquired Novel Corona Virus Disease (COVID-19) ("the Notice"). Amongst other, the Notice deals with:
-occupationally-acquired COVID-19 diagnosis -very high exposure risk occupations
-high exposure risk occupations -medium exposure risk occupations
-low exposure risk occupations -assessment and degrees of impairment
-temporary total disablement payments
-liability for suspected, unconfirmed and confirmed cases
-medical aid provision
-death benefits
-reporting documents; and
-claims processing.
All employers and Medical Service Providers must follow the stipulated prescripts when submitting claims and supporting medical reports for COVID-19.
When submitting reports online through the CompEasy system or Mutual Association Claims systems, Medical Service Providers must use the emergency Covid-19 ICD-10 code: U07.1 as proposed by the World Health Organization (WHO).
The Notice comes into effect on the date of publication (23 March 2020) and is implemented with immediate effect.

Competition Act 89 of 1998: Consumer and Customer Protection and National Disaster Management Regulations and Directions
Highlight:
The Minister of Trade and Industry has published the Consumer and Customer Protection and National Disaster Management Regulations and Directions ("the Regulations").
The intention of these Regulations is to protect consumers from excessive, unfair, unreasonable or unjust pricing of goods and services during the national state of disaster as declared in GG43096, GN313 of 15 March 2020.
Amongst other, the Regulations deal with:
-excessive pricing and the prohibition thereof
-unconscionable, unfair, unreasonable and unjust prices
-the supply and stock of goods; and
-offences and penalties for non-compliance.
The Regulations allow the Minister to take firmer measures if necessary, including setting limits on the number of items a consumer or customer may purchase in a defined period of time.
Any person may make written representation regarding these regulations and directions, no later than 02 April 2020. Representations should be submitted by email to ministry@economic.gov.za.

National Ports Act 12 of 2005: National Ports Act (COVID-19 Restrictions on the movement of persons and crew) Regulations, 2020

The Minister of Transport has published the National Ports Act (COVID-19 Restrictions on the movement of persons and crew) Regulations, 2020 ("the Regulations").
Amongst other, the Regulations:
-prohibit the embarkation and disembarkation of certain persons at South African sea ports
-improve hygiene control and sterilization facilities on ships, sea ports, port facilities operated by licensed operator, off-shore cargo handling facility, port
-repair facilities, provider of port services, port terminals, terminal operations and in licensed port operations
-implement a tracking, tracing and monitoring system at sea port -prohibit the holding of mass gatherings of more than 100 people in sea ports; and
-provide offences and penalties for non-compliance.
The Regulations are effective from 18 March 2020.

Disaster Management Act, 2002: Regulations issued in terms of Section 27(2) of the Act
Highlight:
The Minister of Cooperative Governance and Traditional Affairs, having declared a national state of disaster as published in GG43096, GN313 of 15 March 2020, has published the Regulations issued in terms of Section 27(2) of the Act ("the Regulations").
Amongst other, the Regulations deal with the:
-release of resources
-prevention and prohibition of gatherings
-refusal of medical examination, prophylaxis, treatment, isolation and quarantine
-places of quarantine and isolation -closure of schools and partial care facilities
-suspension of visits by all members of the public to various facilities and centres
-limitation on the sale, dispensing or transportation of alcoholic beverages
-Emergency Procurement Procedures; and
-offences and penalties for non-compliance.
The Regulations are effective from 18 March 2020.

International Air Services Act 60 of 1993 and various other Acts: International Air Services (COVID-19 Restrictions on the Movement of Air Travel) Regulations, 2020 and other Regulations

The Minister of Transport has published the International Air Services (COVID-19 Restrictions on the movement of air travel) Regulations, 2020 ("the Regulations").
Amongst other, the Regulations:
-prohibit the embarkation and disembarkation of foreign nationals at international airports designated as ports of entry
-improve hygiene control and disinfection facilities on international airports designated as ports of entry operated by licensed airport operator, cargo handling facility, airports repair facilities, provider of airports maintenance or services, airport terminals, terminal operations and in licensed airports operations
-implement a tracking, tracing and monitoring system at airports
-prohibit the holding of mass gatherings in and around airports; and
-provide for offences and penalties for non-compliance.
The Regulations are effective from 18 March 2020.
The Minister of Transport has additionally published various Ministerial Orders that detail the compliance and implementation of the International Air Services (COVID-19 Restrictions on the movement of air travel) Regulations, 2020.
The Ministerial Orders remain in force until further notice.

Department of Employment and Labour unveils guidelines dealing with Covid-19 at workplaces

The Department of Employment and Labour (the "Department") have published Guidelines to deal with Covid-19 at the workplace (the "Guidelines").
The Guidelines, which focus on the following areas, should be used by employers and workers to assist in identifying risk levels in the workplace and to determine any appropriate control measures to implement:
-engineering controls
-administrative controls
-safe work practices
-personal protective equipment (PPE)
The Department noted further that employers are to use the prescriptions of the Occupational Health and Safety Act, 85 of 1993, specifically section 8(2)(b) and (d), read with the Regulations for Hazardous Biological Agents, 2001, in managing workplaces in relation to the growing coronavirus pandemic.
An appeal has been made to employers to prepare themselves and their workers as far in advance as possible of potentially worsening outbreak conditions.

Disaster Management Act 57 of 2002: Declaration of a National State of Disaster and Classification of a National Disaster

Classification of a National Disaster GG43096, GN312 of 15 March 2020
The Head of the National Disaster Management Centre has classified the COVID-19 pandemic as a national disaster.
All organs of state have been called upon to strengthen and support the existing structures, to implement contingency arrangements and ensure that measures are put in place to enable the national executive to effectively deal with the effects of this disaster.
Organs of state are required to prepare and submit reports, as required by the National Disaster Management Centre and as outlined in Section 24(4)-(8) of the Act, to the respective intergovernmental forums as listed therein.
Declaration of a National State of Disaster GG43096, GN313 of 15 March 2020 The Minister of Cooperative Governance and Traditional Affairs has declared a national state of disaster, and, may when required, make regulations, issue directions or authorise the issue of directions, only to the extent that it is necessary for the purpose of -
-assisting and protecting the public
-providing relief to the public
-protecting property
-preventing or combatting disruption; or
-dealing with the destructive and other effects of the disaster.
