The Electricity Works (Miscellaneous Temporary Modifications) (Coronavirus) (Scotland) Regulations 2020

The Scottish Ministers have published Regulations which amend the Electricity Works (Environmental Impact Assessment) Regulations 2017 so that:
-the “emergency period” is defined as the period beginning on 24 April 2020 and ending on the date on which the Coronavirus (Scotland) Act 2020 expires
-during the emergency period, developers and planning authorities are not required to ensure that copies of EIA reports and decision notices are available for public inspection at a physical location
-developers must only provide hard copies of an EIA report to Scottish Ministers after the emergency period.

The Health Protection (Coronavirus) (Restrictions) (Scotland) Regulations 2020
Highlight:
The Scottish Ministers have published the Health Protection (Coronavirus) (Restrictions) (Scotland) Regulations 2020 (the "Regulations").
The Regulations, among other things:
-require the closure of businesses selling food or drink for consumption on the premises and listed businesses to protect against the risks to public health arising from coronavirus
-require that a person responsible for carrying on a business or service that may remain open to take all reasonable measures to ensure that a distance of 2 metres is maintained between persons on the premises, only admits people to its premises in sufficiently small numbers to maintain that distance and that a distance of 2 metres is maintained between persons waiting to enter the premises
-stipulate that persons responsible for businesses not listed and which offers goods for sale or hire in a shop or provides library services must stop trading except by making deliveries or an online presence
-stipulate that places of worship, crematoriums and community centres must close subject to exceptions
-prohibit people from leaving the place where they live unless they have a reasonable excuse
-sets out penalties for non-compliance.
The restrictions and requirements imposed by the Regulations will be reviewed at least once every 21 days, with the first review being carried out by 16th April 2020. The Regulations expire 6 months from the day they come into force.

The Non-Domestic Rates (Coronavirus Reliefs) (Scotland) Regulations 2020
Highlight:
The Scottish Ministers have published the Non-Domestic Rates (Coronavirus Reliefs) (Scotland) Regulations 2020 (the "Regulations").
The Regulations introduce reliefs in relation to non-domestic rates for the financial year beginning on 1 April 2020 by:
-granting a general reduction of 1.6% in rates to all non-domestic ratepayers for any day in that year
-removing any liability to pay rates on a day in that year where lands and heritages are used for one or more of the purposes described in Schedule 1
-removing any liability for lands and heritages operated as an airport that are used for handling services or are occupied by a named company
-making consequential amendments to other Regulations that provide a relief from liability to pay rates.
