Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States)
Highlight:
Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, has published an Order prohibiting a foreign national from entering Canada from the United States if they have COVID-19 or have signs and symptoms of COVID-19 or have reasonable grounds to suspect they have such signs and symptoms, including:
-a fever and cough; or
-a fever and breathing difficulties.
A foreign national is further prohibited from entering Canada from the United States if they seek to enter for an optional or discretionary purpose, such as tourism, recreation or entertainment.
This Order does not apply to:
-a citizen of the United States
-a stateless habitual resident of the United States; or
-a person who
1. has not attained the age of 18 years and is not accompanied by their mother, father or legal guardian within the meaning of the Immigration and Refugee Protection Regulations,
2. has neither a spouse nor a common-law partner within the meaning of those Regulations, and
3. has neither a mother or father nor a legal guardian within the meaning of those Regulations in the United States.
This Order has effect for the period beginning on 22 April 2020 and ending on 21 May 2020.

Protection against liability (COVID-19) Order
Highlight:
The Minister of Public Safety and Solicitor General of the Province of British Columbia published an Order which aims to protect persons who operate or provide essential services, from liability for damages relating, directly or indirectly, to COVID-19.
The Order and its protection applies if those persons operate or provide those services, or reasonably believe that they are operating or providing those services, in accordance with all applicable emergency and public health guidance.
A list of essential services falling within the scope of the Order is included in the Schedule thereof.

Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from any Country other than the United States)
Highlight:
Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, has published an Order prohibiting any foreign national from entering Canada if they arrive from a foreign country other than the United States.
This Order does not apply to:
-an immediate family member of a Canadian citizen or of a permanent resident as defined in subsection 2(1) of the Immigration and Refugee Protection Act
-a person who is authorized, in writing, by an officer designated under subsection 6(1) of the Immigration and Refugee Protection Act or by a consular officer of the Government of Canada, to enter Canada for the purpose of reuniting immediate family members
-a crew member as defined in subsection 101.01(1) of the Canadian Aviation Regulations or a person who seeks to enter Canada only to become such a crew member
-a member of a crew as defined in subsection 3(1) of the Immigration and Refugee Protection Regulations or a person who seeks to enter Canada only to become such a member of a crew
-a person who is exempt from the requirement to obtain a temporary resident visa under paragraph 190(2)(a) of the Immigration and Refugee Protection Regulations and the immediate family members of that person
-a person who seeks to enter Canada at the invitation of the Minister of Health for the purpose of assisting in the COVID-19 response
-a person who arrives by any means of a conveyance operated by the Canadian Forces or the Department of National Defence
-a member of the Canadian Forces or a visiting force, as defined in section 2 of the Visiting Forces Act, and the immediate family members of that member
-a French citizen who resides in Saint-Pierre-et-Miquelon and has been only in Saint-Pierre-et-Miquelon, the United States or Canada during the period of 14 days before the day on which they arrived in Canada
-a person or any person in a class of persons who, in the opinion of the Chief Public Health Officer appointed under subsection 6(1) of the Public Health Agency of Canada Act:
1. does not pose a risk of significant harm to public health, or
2. will provide an essential service while in Canada
-a person whose presence in Canada, in the opinion of the Minister of Foreign Affairs, the Minister of Citizenship and Immigration or the Minister of Public Safety and Emergency Preparedness, is in the national interest
-a person who arrives by means of a vessel as defined in section 2 of the Canada Shipping Act, 2001, if the vessel departed before 00:00:01 am Eastern Daylight Time on March 21, 2020 and had a scheduled destination of Canada upon its departure
-the holder of a valid work permit or a study permit as defined in section 2 of the Immigration and Refugee Protection Regulations
-a person whose application for a work permit referred to in paragraph (m) was approved under the Immigration and Refugee Protection Act and who has received written notice of the approval, but who has not yet been issued the permit
-a person whose application for a study permit referred to in paragraph (m) was approved under the Immigration and Refugee Protection Act, and who received written notice of the approval before noon, Eastern Daylight Time on March 18, 2020, but who has not yet been issued the permit
-a person permitted to work in Canada as a student in a health field under paragraph 186(p) of the Immigration and Refugee Protection Regulations
-a person permitted to work in Canada as a provider of emergency services under paragraph 186(t) of the Immigration and Refugee Protection Regulations
-a licensed health care professional with proof of employment in Canada
-a person who seeks to enter Canada for the purpose of delivering, maintaining, or repairing medically-necessary equipment or devices
-a person who seeks to enter Canada for the purpose of making medical deliveries of cells, blood and blood products, tissues, organs or other body parts, that are required for patient care in Canada during or within a reasonable period of time after the expiry of the Order
-a person whose application for permanent residence was approved under the Immigration and Refugee Protection Act, and who received written notice of the approval before noon, Eastern Daylight Time on March 18, 2020, but who has not yet become a permanent resident under that Act; or
-a worker in the marine transportation sector who is essential for the movement of goods by vessel, as defined in section 2 of the Canada Shipping Act, 2001, and who seeks to enter Canada for the purpose of performing their duties in that sector.
This Order has effect for the period beginning on the day on which it is made (26 March 2020) and ending on 30 June 2020.

Minimizing the Risk of Exposure to COVID-19 in Canada Order (Mandatory Isolation), No. 2
Highlight:
Her Excellency the Governor General in Council, on the recommendation of the Minister of Health has published an Order requiring every person entering Canada who is not exhibiting signs and symptoms of COVID-19 (this includes a fever and cough, or a fever and difficulty breathing) to:
-Quarantine themselves in accordance with the instructions of the screening/quarantine officer for a period of 14 days, beginning on the day that they enter Canada; and
-Monitor for signs and symptoms of COVID-19 until the 14-day period ends and, if they develop symptoms, follow instructions provided by the screening/quarantine officer.
The 14-day period will restart if the person develops any signs and symptoms of COVID-19 during the initial quarantine period, or is exposed to someone else who exhibits signs and symptoms of COVID-19.
Additionally the Order obligates every person to wear a non-medical mask or face covering (of a type considered appropriate by the screening/quarantine officer) upon entry and while in transit to isolation or quarantine, unless the mask or face covering needs to be removed for security or safety reasons.
Failure to comply with the Order is considered an offence under the Quarantine Act.

Guidance for Essential Workers Returning to British Columbia
Highlight:
The Ministry of Health has published guidance for returning travellers who are essential workers. This guidance does not apply to people who are listed in Appendix A of the document, who have been identified by the federal government and Canada’s Chief Public Health Officer as essential workers and that are coming into Canada solely for the purpose of providing an essential service.
On 14 April the Federal Government published a revised Emergency Order (Minimizing the Risk of Exposure to COVID-19 in Canada Order (Mandatory Isolation), No. 2) on which you were previously notified. The Emergency Order requires everyone who enters Canada to self-isolate for 14 days upon their arrival. This includes travel by land, air, and sea, and applies whether people have symptoms of COVID-19 or not.
If your employer deems you are an essential worker, and you are returning to BC from outside of Canada, and you are not sick, you are considered an exempted person from these federal and provincial Orders, however, various measures must be implemented:
-Self-isolate when you are not working
-Stay home if you are sick; if your illness is mild enough to treat at home, stay home for -10 days starting with the day your symptoms started
-Follow the infection prevention and control protocols of your employer to prevent the spread of COVID-19
-Wash your hands frequently and avoid touching your face
-Try to maintain a two-metre distance from customers and fellow workers as much as possible; and
-Avoid unnecessary visits to public establishments except for basic needs.

Travellers and Employers Order
Highlight:
The Ministry of Health has published an Order that applies to:
-All persons entering Canada through British Columbia or coming into British Columbia after entering Canada after 8 April 2020 ("Travellers")
-Employers who provide accommodation for temporary foreign workers
-Employers of travellers who are essential workers; and
-Travellers who are essential workers who are permitted to work by their employers.
Travellers who are essential workers and are permitted to work must:
-follow the COVID-19 infection control protocol of their employer to prevent the transmission of SARS-VoV-2 infection
-self-monitor daily for signs and symptoms of illness
-follow infection prevention and control protocols including diligent hand hygiene
-avoid standard greetings that require physical contact, such as shaking hands
-to the extent practical, reduce close contact with other workers by maintaining a two metre separation and avoiding shared spaces
-avoid close contact with others when travelling to and from work and between shifts
-self-isolate at home on days when not required at the workplace as described at this website and in procedures issued by the British Columbia Centre for Disease Control
-follow all the recommended procedures provided by a provincial information and support officer
-avoid any unnecessary visits to public establishments
-call a health care practitioner if they come into contact with anyone who has tested positive for COVID-19 and who is self-isolating
-if they exhibit symptoms of illness, call a health practitioner and self-isolate for 14 days unless instructed otherwise by a health practitioner
-submit to such medical tests and provide such specimens as are, from time to time, considered necessary by health professionals for the purpose of identifying or controlling the transmission of SARS-CoV-2.
This Order does not have an expiration date.

Interim Communicable Disease Control Guidelines for Industrial Camps
Highlight:
The British Columbia Centre for Disease Control has published a Guide highlighting key communicable disease preparedness and response measures that can be taken by industrial camps in relation to COVID-19.
The Guide is independent of and does not negate WorkSafe BC or Industrial Camps Regulation requirements, and:
-states how COVID-19 is spread
-details the need to keep staff and camp residents informed
-provides a plan on how to manage individuals with suspected COVID-19 infection
-requires the notification of an outbreak or suspected outbreak to the local Medical Health Officer
-suggests the implementation of physical distancing and regular cleaning and disinfection; and
-lists considerations and recommendations for on-site medical clinics.
This guidance is also based upon current knowledge and it should be understood that guidance is subject to change as new data become available and new developments arise with this new virus.

Preventing exposure to COVID-19 in the workplace: A guide for employers

WorkSafeBC has published a Guide for employers relating to the prevention of workplace exposure to COVID-19.
The Guide aims to provide clarity to the orders and directives regarding minimum workplace standards of the provincial health officer (PHO) and the British Columbia Centre of Disease Control.
It is suggested that employers in the jurisdiction of British Columbia address health and safety concerns in the workplace by:
-identifying exposure hazards and developing measures to control exposure
-controlling the number of people on site; and
-implementing certain prohibitions on workers who are sick and those returning from outside Canada.

Canada’s COVID-19 Economic Response Plan: Support for Canadians and Businesses

The Government of Canada has published Canada’s COVID-19 Economic Response Plan: Support for Canadians and Businesses (the "Plan").
