Public Treasury (Administration and Payments) (Temporary Unemployment Benefit) Amendment (No. 2) Regulations 2020

Highlight:

Quarantine (Extension of Quarantine) Order 2020

Highlight:

The Minister of Health has published an Order that obligates persons placed in quarantine under the Quarantine (Incoming Traveller) Order 2020, who test positive for COVID-19, to continue under quarantine at a place approved by the Quarantine Authority for an extended period that shall not exceed 14 days from the end of the initial quarantine period.

Any person who contravenes this Order commits an offence under section 11 of the Quarantine Act 2017.

Occupational Safety and Health (COVID-19) Temporary Regulations 2020

Highlight:

The Minister responsible for health, being of the opinion that due to the coronavirus (COVID-19) pandemic a public health emergency exists, has published the Occupational Safety and Health (COVID-19) Temporary Regulations 2020 ("the Temporary Regulations"). 

The Temporary Regulations place an obligation on employers to make arrangements for employees to work remotely from home wherever reasonably practicable using electronic means or otherwise and provides for offences and penalties for non-compliance.

Quarantine (Incoming Traveller) Order 2020

Highlight:

The Minister responsible for health, being of the opinion that due to the coronavirus (COVID-19) pandemic a public health emergency exists, has published the Quarantine (Incoming Traveller) Order 2020 ("the Order").

The Order places an obligation on persons under various circumstances to quarantine, and provides for offences and penalties for non-compliance.

The provisions of the Quarantine Act 2017, in particular the Quarantine (COVID-19) Order 2020 and the Public Health Act 1949, in particular the Public Health (COVID-19) Regulations 2020, shall apply to a person who has landed in Bermuda.

This notification has been included for information purposes only, despite the fact that the Order does not impose obligations on your organisation.

Emergency Powers (COVID-19 Shelter in Place) Regulations 2020

Highlight:

The Governor, being of the opinion that COVID-19 is an unprecedented and severe threat to public health in Bermuda has published the Emergency Powers (COVID-19 Shelter in Place) Regulations 2020 ("the Regulations").

Amongst others, the Regulations deal with the:

-implementation of a curfew
-mandatory closures of non-essential businesses
-closure of schools and day care
-application of remote working
-permission of permitted businesses to remain open
-provision of utilities, telecommunications etc.
-restriction on visitations
-closure of beaches, parks and playgrounds
-restriction on road traffic; and
-offences and penalties for non-compliance.

Highlight:

The Minister responsible for health, being of the opinion that due to the coronavirus (COVID-19) pandemic a public health emergency exists has published the Quarantine (Travel Ban) (No. 2) Amendment Order 2020 ("the Amendment Order").

The Amendment Order creates changes to the Quarantine (Travel Ban) (No. 2) Order 2020, published on 19 March 2020 detailing various measures that have been put in place to effectively deal with the effects of COVID-19.

The Amendment Order deals with the travel ban placed on persons entering Bermuda, and the obligation thereof to comply with any requirements under the Quarantine Act 2017 and the Public Health Act 1949.

Bermuda: Regulatory Authority (COVID-19) Emergency General Determination 2020

Highlight:

The Regulatory Authority has published the Regulatory Authority (COVID-19) Emergency General Determination 2020 ("the EGD").

The EGD applies to the Electronic Communications and Electricity sectors and is binding on all sectoral licensees.

The EGD provides for the prohibition of:

-disruption, disconnection or discontinuance of services for non-payment by a Relevant Person; or
-charging of penalties or other fees for non-payment to a Relevant Person (for the avoidance of doubt, this EGD does not apply to penalties for breach of handset or other device contracts associated with switching service providers); or
-increasing tariffs to Consumers and Small Businesses,

during the period of the COVID-19 pandemic applicable to Bermuda as determined by the RA, the Bermuda Government or the Governor of Bermuda from the Effective Date of this EGD.

Bermuda: Public Treasury (Administration and Payments) (Temporary Unemployment Benefit) Regulations 2020

Highlight:

The Minister of Finance has published the Public Treasury (Administration and Payments) (Temporary Unemployment Benefit) Regulations 2020 ("the Regulations").

The Regulations intend to assists the Government in its commitment to provide access to temporary unemployment benefits to individuals directly impacted by COVID-19.

Amongst others, the Regulations deal with:

-persons qualified to apply for unemployment benefit
-scope and duration of unemployment benefit
-application for unemployment benefit
-conditions applicable to unemployment benefit
-suspension or cancellation of unemployment benefit; and
-offences and penalties for providing false information.

Bermuda: Quarantine (COVID-19) Order 2020

Highlight:

The Minister responsible for health, being of the opinion that a public health emergency exists has published the Quarantine (COVID-19) Order 2020 ("the Order"). 

The Order places an obligation on persons under various circumstances to quarantine, and provides for offences and penalties for non-compliance. 

The provisions of the Public Health (COVID-19) Regulations 2020, in addition to the provisions of this Order, shall apply to a person who has landed in Bermuda.

Bermuda: Quarantine (Travel Ban) (No. 2) Order 2020

Highlight:

The Minister responsible for health, being of the opinion that due to the coronavirus (COVID-19) pandemic a public health emergency exists, has published the Quarantine (Travel Ban) (No. 2) Order 2020 ("the Order"). 

The Order details that a person shall not enter Bermuda unless the person

-belongs to Bermuda within the meaning of section 11(5) of the Constitution

-is a resident of Bermuda or a dependant of such person who has permission to reside in Bermuda under the Bermuda Immigration and Protection Act 1956

-is a crew member of a cargo, commercial aircraft or a cargo ship; or

-has written permission of the Quarantine Authority to enter Bermuda.

 

Any person who enters Bermuda shall comply with any requirements under the Quarantine Act 2017 and the Public Health Act 1949. 

The Quarantine (Travel Ban) Order 2020 (BR 11 / 2020) is hereby revoked, and will be removed from the "Guidelines, Manuals, Frameworks and Management Plans" folder on your Legal Register.

Bermuda: Public Health (COVID-19) Regulations 2020

Highlight:

The Minister of Health has published the Public Health (COVID-19) Regulations 2020 ("the Regulations"). 

Amongst others, the Regulations deal with:

-powers to contain COVID-19, and the restrictions and requirements thereof

-public health supervision

-active monitoring and isolation

-enforcement of monitoring and reporting

-temporary isolation hospitals; and

-offences and penalties for non-compliance.

These Regulations cease to have effect at the end of the period of two years beginning on the day on which they come into force (20 March 2020).

Quarantine (Travel Ban) Order 2020

Highlight:

The Minister responsible for health, being of the opinion that a public health emergency exists, after consultation with the Chief Medical Officer, has published the Quarantine (Travel Ban) Order 2020 ("the Order").

The Order details that a person who has been in a listed country, or travelled via a listed countries, in the 14 days preceding commencement of this Order or after commencement of this Order; and who is not resident in Bermuda, or who is a visitor to Bermuda, shall be denied entry into Bermuda.

“listed country” as referred to is:

-China

-Iran

-Italy; and

-Republic of Korea: Daegu or Cheongdo.
